Vermilion City Council’s rescheduled meeting on Wednesday, Jan. 28 included a discussion about why a meeting originally scheduled for Monday, Jan. 26 did not take place and what authority city officials have when hazardous weather affects public safety.
Council President Jeff Lucas said the Jan. 26 meeting was moved after weather conditions raised safety concerns and the council chambers facility was closed. Lucas said he sought guidance from the city’s law department to clarify how authority is divided between City Council and the mayor in such situations.
Lucas said he was advised that City Council has authority to determine the time and place of its meetings, while the mayor, as the city’s chief executive, has authority to close municipal facilities due to inclement weather or safety concerns. Because the facility was closed, Lucas said council agreed to reschedule the meeting to Jan. 28.
Assistant Law Director Scott Orille explained during the meeting that while council controls whether a meeting is canceled, the mayor’s authority to close municipal buildings for safety reasons can prevent a meeting from being held at that location.
During discussion, Councilman Drew Werley asked for clarity on whether closing the building effectively canceled the meeting. Councilman Gary Howell raised concerns about the municipal complex functioning as a courthouse and referenced the role of the municipal judge in court operations. Councilman Greg Drew focused on communication, questioning how the situation was described publicly and whether messaging clearly distinguished between closing a facility and canceling a meeting.
Mayor Russ Owens addressed the issue during his report, saying he did not cancel the Jan. 26 council meeting but closed the council chambers facility as a safety precaution due to hazardous weather conditions. Owens apologized for a public notice that stated he had canceled the meeting, saying that wording was inaccurate.
Lucas said he plans additional discussions with the law director to clarify procedures and improve communication during future weather-related disruptions.
