Vermilion Zoning Board Splits on Driveways, Sheds, Homes

The Vermilion Board of Zoning Appeals met on July 22 to consider a range of residential variance requests, ultimately approving three new construction-related requests while denying a homeowner’s bid to keep a gravel driveway and another’s request to place a shed within six inches of a neighboring property.

Gravel Driveway Request Denied on Jefferson Street

Brian Buffington of Jefferson Street sought a variance to maintain a gravel driveway in the R-4 Urban Residence District. Buffington cited financial limitations and drainage concerns, stating that the property’s existing layout made a hard-surfaced driveway difficult and costly, estimating concrete work alone at $6,000–$10,000.

While Buffington said neighbors supported the request, a nearby resident voiced concern about the property’s appearance and the potential for the variance to set a precedent for non-compliance in the neighborhood.

The board voted 3–2 to deny the request, with members Pete Bahner, Bob Voltz, and Liz Phillips opposed.

Linwood Park New Home Plans Approved

Architect Jill Brandt, representing homeowner Chris Wolf, received unanimous approval for reduced setback variances to construct a 2,200-square-foot home at 436 Walnut Street in Linwood Park. The board approved a rear setback of 6 feet (versus the required 30) and a side setback of 3 feet (versus 7), noting the proposed design aligns with the neighborhood’s established layout. No objections were received from Linwood Park or adjacent property owners.

Split Decision on State Street Shed

Daniel Lachowyn of State Street sought to retain a shed already built too close to his property lines. After discovering part of the shed extended past the boundary, Lachowyn moved it approximately six inches and applied for variances.

The board approved the rear setback variance (2 feet from the property line), but unanimously denied the side yard variance, which would have allowed the shed to remain just six inches from a neighbor’s property. Neighbor John Sobiesky objected to the shed’s placement and size. Board members encouraged the applicant to return with adjusted plans showing greater separation.

New Build on Edgewater Drive Clears Hurdles

Sallie Landoll received approval to replace her existing home at Edgewater Drive with a new structure closer to the lot lines than typically allowed. Variances were granted for reduced front and side yard setbacks, along with a waiver of the city’s sidewalk requirement.

Board members noted the home borders Showse Park, which has no sidewalks, and said enforcing sidewalk continuity in that area remains challenging.

Next Meeting

The Board of Zoning Appeals will next meet on Tuesday, August 26, 2025, at 6:00 p.m. at the Vermilion Municipal Court Complex.
